Terms and Conditions

These Terms and Conditions govern your access to and use of the hockey referee scheduling website, application, text messaging program, and related services operated by Tractable Solutions. Collectively, these are referred to as the “Service.”
Please read these Terms and Conditions carefully. By creating an account, accessing the Service, or using any part of the Service, you agree to these Terms and Conditions and our Privacy Policy.
If you do not agree to these Terms and Conditions, you may not use the Service.
1. About the Service
The Service provides tools that may be used by hockey leagues, associations, assignors, administrators, referees, officials, scorekeepers, and other authorized users to:
Create and manage officiating accounts
Maintain referee qualifications and availability
Schedule and assign referees and other officials
Accept or decline game assignments
Identify and fill open assignments
Communicate schedules, reminders, changes, and cancellations
Manage game, rink, league, and officiating information
Maintain assignment and officiating records
Facilitate related administrative activities
Tractable Solutions provides the technology used to support these functions. Unless expressly stated otherwise, Tractable Solutions does not operate the hockey leagues, associations, teams, games, or facilities using the Service.
2. Eligibility and Account Registration
You must provide accurate, complete, and current information when registering for an account.
You are responsible for:
Maintaining the accuracy of your account information
Protecting your username and password
Restricting unauthorized access to your account
Keeping your telephone number and email address current
Promptly notifying us of suspected unauthorized access
All activity conducted through your account
You may not create an account using another person’s identity or provide false or misleading information.
We may suspend or terminate accounts that contain inaccurate information, are used without authorization, or violate these Terms and Conditions.
3. Minors
Some referees, scorekeepers, or other users may be under 18 years of age.
A minor may use the Service only with the permission and supervision required by the applicable hockey organization and the minor’s parent or legal guardian.
By permitting a minor to register for or use the Service, the parent or legal guardian agrees to these Terms and Conditions on behalf of the minor and accepts responsibility for the minor’s use of the Service.
The Service is not intended for children under 13 without appropriate parental or organizational authorization.
4. Referee Qualifications and Eligibility
Users are responsible for maintaining any certifications, registrations, training, background checks, SafeSport requirements, insurance, age requirements, or other qualifications required by the applicable league, association, governing body, or law.
The Service may display qualifications or eligibility information provided by users or hockey organizations. Tractable Solutions does not independently guarantee that this information is accurate or current.
The decision to assign, approve, suspend, evaluate, or remove a referee or other official is generally made by the applicable assignor, league, association, or governing organization, not by Tractable Solutions.
5. Game Assignments
A game assignment is subject to the rules, policies, and procedures of the league, association, assignor, rink, or other organization responsible for the game.
Users are responsible for reviewing assignment details, including:
Date and time
Rink and location
Level of play
Assigned position
Reporting time
Compensation
Required uniform or equipment
Applicable league rules
Any special instructions
Accepting an assignment may create a commitment between the user and the applicable hockey organization or assignor.
Users should promptly accept, decline, or respond to assignment requests as required. A user who can no longer work an accepted assignment must follow the applicable cancellation, replacement, or reassignment procedure.
Tractable Solutions does not guarantee that any user will receive a minimum number of assignments, any particular assignment, or any amount of compensation.
6. Schedule Changes and Cancellations
Game times, locations, assignments, and other details may change.
Users are responsible for regularly checking the Service and their designated communication channels for updated information.
Although the Service may send email or text message notifications, these notifications are provided as a convenience. Delivery is not guaranteed. A delayed, blocked, or undelivered notification does not necessarily excuse a user from responsibilities associated with an assignment.
Hockey organizations, assignors, teams, rinks, or other users may cancel or modify assignments. Tractable Solutions is not responsible for losses, expenses, missed compensation, travel costs, or other consequences resulting from a cancellation, schedule change, reassignment, or inaccurate information supplied by another user or organization.
7. Text Message Program
Tractable Solutions may offer SMS or MMS text message notifications to registered users who provide a mobile telephone number and expressly consent to receive messages.
Messages may include:
New referee assignments
Open assignment opportunities
Assignment confirmations
Assignment acceptance or decline notices
Game schedules
Game reminders
Schedule changes
Game cancellations
Rink or location changes
Urgent officiating notices
Account or security notifications
Other operational messages related to the Service
Message frequency varies based on the user’s assignments, schedule activity, league activity, and account settings.
Message and data rates may apply according to the user’s wireless service plan.
Consent to receive text messages is voluntary and is not a condition of purchasing goods or services. Users may continue to access available non-SMS portions of the Service after opting out of text messages.
To stop receiving text messages, reply STOP to any message. Users may receive one final confirmation message after opting out.
To request assistance, reply HELP or contact bill@tractable.com.
Users may also recognize commonly supported opt-out requests, including CANCEL, END, QUIT, STOPALL, REVOKE, OPTOUT, and UNSUBSCRIBE, depending on the messaging system configuration.
After opting out, a user will not receive additional text messages unless the user takes an affirmative action to provide renewed consent.
Wireless carriers are not liable for delayed or undelivered messages.
Text message availability may vary by carrier, device, telephone number, and geographic area.
8. SMS Consent and Telephone Number Responsibilities
By opting into text messages, you confirm that:
You are the subscriber or authorized user of the telephone number provided
You authorize Tractable Solutions to send automated or non-automated operational text messages to that number
Your consent relates specifically to hockey officiating, scheduling, assignment, account, and service notifications
You will notify us or update your account if your telephone number changes
You will opt out before transferring or discontinuing the telephone number when reasonably possible
Tractable Solutions may maintain records of when, where, and how SMS consent was provided and when an opt-out request was received.
Mobile telephone numbers and messaging consent information will not be sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes.
Telephone numbers and related information may be provided to service providers, including Twilio and telecommunications carriers, solely as necessary to operate and deliver the messaging program.
9. Email and Other Communications
By creating an account, you authorize Tractable Solutions and authorized hockey organizations using the Service to send administrative and operational communications related to your account, assignments, schedules, security, and use of the Service.
Some communications may be necessary to operate the Service and may not be considered promotional communications.
You are responsible for maintaining current contact information and monitoring the communication methods associated with your account.
10. Payments and Compensation
The Service may display or facilitate information relating to referee fees, game payments, reimbursements, or other compensation.
Unless expressly stated otherwise, compensation obligations are between the referee or official and the applicable league, association, team, assignor, rink, or other organization.
Tractable Solutions does not guarantee payment and is not responsible for:
The amount of compensation offered
Payment delays
Withheld or disputed payments
Tax reporting
Employment classification
Reimbursement of travel or other expenses
Disagreements between users and hockey organizations
Users are responsible for their own tax, employment, insurance, and financial obligations arising from officiating activities.
11. Independent Relationships
Use of the Service does not by itself create an employment, agency, partnership, joint venture, franchise, or fiduciary relationship between Tractable Solutions and any referee, official, assignor, league, association, or other user.
Tractable Solutions does not control how games are officiated, how users are evaluated, or how hockey organizations manage their officials.
Any employment or independent-contractor relationship involving a referee or official is determined by the parties involved and applicable law.
12. Acceptable Use
You agree not to:
Use the Service for an unlawful or fraudulent purpose
Impersonate another person
Provide false account, certification, or availability information
Access another user’s account without authorization
Attempt to bypass security or access restrictions
Interfere with the operation of the Service
Introduce malware, harmful code, or automated attacks
Scrape or systematically extract information without authorization
Harass, threaten, discriminate against, or abuse another user
Use contact information obtained through the Service for unrelated solicitation
Send spam, unauthorized advertising, or promotional messages
Misuse referee, minor, league, or scheduling information
Reverse engineer or copy the Service except where prohibited by law
Use the Service in a manner that could harm Tractable Solutions or another person
We may investigate suspected violations and take appropriate action, including restricting or terminating access.
13. User Content and Information
Users and hockey organizations may submit schedules, availability, qualifications, evaluations, instructions, comments, messages, and other information through the Service.
You retain ownership of information you submit.
You grant Tractable Solutions a limited, nonexclusive right to host, store, process, reproduce, and display that information as reasonably necessary to operate, maintain, secure, and improve the Service.
You represent that you have the right to provide the information you submit and that doing so does not violate another person’s rights or applicable law.
14. Privacy
Our collection, use, retention, and disclosure of personal information are described in our Privacy Policy.
By using the Service, you acknowledge that you have reviewed the Privacy Policy.
The Privacy Policy is incorporated into these Terms and Conditions by reference.
15. Third-Party Services
The Service may use or link to third-party services, including hosting providers, payment processors, mapping services, email providers, telecommunications providers, and Twilio.
Third-party services may be governed by their own terms and privacy policies.
Tractable Solutions is not responsible for the availability, security, accuracy, content, or practices of third-party services that it does not control.
16. Service Availability
We seek to provide a reliable Service, but we do not guarantee uninterrupted, timely, secure, or error-free access.
The Service may be unavailable due to:
Maintenance
Software or hardware failures
Internet or carrier interruptions
Cybersecurity events
Third-party service outages
Weather or emergency conditions
Events beyond our reasonable control
We may modify, suspend, or discontinue all or part of the Service at any time.
Where reasonably practical, we may provide notice of material changes or interruptions.
17. Intellectual Property
The Service, including its software, design, graphics, branding, databases, and original content, is owned by or licensed to Tractable Solutions and is protected by applicable intellectual-property laws.
These Terms provide a limited, revocable, nonexclusive, nontransferable right to use the Service for its intended purpose.
No ownership rights are transferred to users.
You may not copy, distribute, sell, license, modify, or create derivative works from the Service without written permission, except as permitted by applicable law.
18. Account Suspension and Termination
You may stop using the Service at any time.
Tractable Solutions may suspend, limit, or terminate access if:
You violate these Terms and Conditions
Your use presents a security or legal risk
Your account information is false or unauthorized
An applicable hockey organization requests removal of your access
You misuse personal or scheduling information
Suspension is reasonably necessary to protect users or the Service
The Service is discontinued
Termination does not eliminate obligations that arose before termination.
Provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, disputes, and other provisions that by their nature should survive will remain effective.
19. Disclaimer of Warranties
To the fullest extent permitted by law, the Service is provided on an “as is” and “as available” basis.
Tractable Solutions disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.
We do not warrant that:
The Service will always be available or error-free
All schedules or assignments will be accurate
Notifications will always be delivered
Users will receive assignments or compensation
User-provided information will be accurate
The Service will meet every league’s or user’s requirements
Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you.
20. Limitation of Liability
To the fullest extent permitted by law, Tractable Solutions and its owners, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
This includes damages relating to:
Missed or changed assignments
Lost compensation
Travel costs
Undelivered notifications
Data loss
Loss of access
Scheduling errors
Conduct of other users
Personal injury or property damage associated with hockey activities
Unauthorized account access
Reliance on information provided through the Service
To the fullest extent permitted by law, the total liability of Tractable Solutions arising from or relating to the Service will not exceed the greater of:
The amount you paid directly to Tractable Solutions for use of the Service during the 12 months preceding the event giving rise to the claim, or
One hundred dollars.
Some jurisdictions do not permit certain liability limitations, so some limitations may not apply.
21. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Tractable Solutions and its owners, officers, employees, contractors, and service providers from claims, liabilities, damages, losses, and expenses arising from:
Your use or misuse of the Service
Your violation of these Terms and Conditions
Information you submit
Your violation of another person’s rights
Your officiating activities or conduct
Your violation of league, association, or governing-body requirements
Unauthorized use of your account caused by your failure to protect your credentials
22. Governing Law
These Terms and Conditions are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.
Any legal proceeding arising from these Terms or the Service must be brought in a state or federal court located in Massachusetts, unless applicable law requires otherwise.
You consent to the jurisdiction and venue of those courts.
23. Changes to These Terms
We may update these Terms and Conditions periodically.
When changes are made, we will update the effective date shown at the top of this document. We may provide additional notice through the Service or by email when changes are material.
Your continued use of the Service after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
24. Severability
If any provision of these Terms and Conditions is found unenforceable, the remaining provisions will remain in effect.
The unenforceable provision will be interpreted or modified to the minimum extent necessary to make it enforceable while preserving its intended purpose.
25. Entire Agreement
These Terms and Conditions, together with the Privacy Policy and any additional written terms applicable to a particular feature, constitute the entire agreement between you and Tractable Solutions concerning the Service.
